We will never sell your personal information to third parties for their marketing purposes without your explicit consent. You have the right to request access to, correction of, or deletion of your personal information, subject to our legal obligations and legitimate business interests.

VinDetailsNow reserves the right, in its sole discretion, to modify, update, or replace these Terms, the Privacy Policy, or any other policy at any time, for any reason, with or without prior notice. We will make reasonable efforts to notify users of material changes by posting a notice on our website, sending an email to the address associated with your account, or through other reasonable means. Changes will become effective immediately upon posting to our website unless otherwise specified. Your continued use of the Services after any modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to any modifications, you must immediately cease using the Services. The "Last Updated" date at the top of these Terms indicates when the most recent changes were made. We may also require you to provide explicit consent to material changes before you can continue using certain features of our Services.

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our Services. By using our Services, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal authority to enter into these Terms; (c) you are not prohibited by law from using our Services; (d) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; (e) you are not listed on any U.S. Government list of prohibited or restricted parties; and (f) all information you provide to us is accurate, current, and complete. If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. We reserve the right to verify your eligibility at any time and may request additional documentation to confirm your identity or age. Failure to meet these eligibility requirements or providing false information constitutes a material breach of these Terms and may result in immediate termination of your account.

VinDetailsNow operates as an information aggregation and distribution platform that compiles and presents vehicle history reports from various third-party data sources. We act solely as an intermediary and do not create, verify, endorse, or guarantee the accuracy, completeness, timeliness, or reliability of any information contained in our reports. The data we provide is compiled from sources that may include but are not limited to: government databases, insurance companies, auto auctions, salvage yards, repair facilities, vehicle manufacturers, and other public and private sources. We do not conduct independent investigations or physical inspections of vehicles. We are not an automotive expert, mechanic, insurance company, or legal advisor. Our Services are intended to provide general information only and should not be used as the sole basis for making purchasing, selling, or other significant decisions regarding a vehicle. We make no representations or warranties regarding the condition, title status, accident history, or any other aspect of any vehicle. Users should conduct their own due diligence, including independent inspections and verification of information, before making any vehicle-related decisions. We expressly disclaim any responsibility for errors, omissions, or inaccuracies in the data provided by third parties.

Subject to your compliance with these Terms, VinDetailsNow grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services solely for your personal, non-commercial purposes. This license does not include any right to: (a) resell, redistribute, or commercially exploit the Services or any content therein; (b) modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Services; (c) remove, alter, or obscure any proprietary notices on the Services; (d) use any automated system, including but not limited to robots, spiders, or scrapers, to access the Services; (e) frame or mirror any part of the Services without our prior written consent; (f) use the Services to build a competitive product or service; (g) access the Services to monitor their availability, performance, or functionality for benchmarking purposes; or (h) circumvent any technological measures we use to protect the Services. This license automatically terminates if you violate these Terms. Upon termination, you must immediately cease all use of the Services and destroy any downloaded or printed materials. We reserve all rights not expressly granted to you in these Terms. Any unauthorized use of the Services automatically terminates your license and may subject you to legal liability.

Our vehicle history reports contain information obtained from third-party sources that are beyond our control. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (a) We do not independently verify the accuracy, completeness, or timeliness of third-party data; (b) Third-party data sources may contain errors, omissions, or outdated information; (c) Not all accidents, damages, repairs, or other significant events may be reported to the sources we use; (d) The absence of information in a report does not mean that an event did not occur; (e) Reports may not include the complete history of a vehicle; (f) Information may be reported with delays or may never be reported at all; (g) Different data sources may provide conflicting information; (h) We have no obligation to update reports after they are generated; and (i) We are not responsible for any decisions you make based on the information in our reports. You should NOT rely solely on our reports when making vehicle-related decisions. We strongly recommend that you: obtain a professional inspection, verify information through multiple sources, contact relevant authorities or entities directly, and consult with qualified professionals. VinDetailsNow makes no representations or warranties, express or implied, regarding the accuracy, reliability, completeness, or timeliness of any third-party content. Your use of third-party content is entirely at your own risk.

BY USING OUR SERVICES, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT: (a) Your use of the Services is entirely at your own risk; (b) You assume full responsibility for any decisions you make based on information obtained through our Services; (c) You release, waive, discharge, and covenant not to sue VinDetailsNow, its affiliates, subsidiaries, officers, directors, employees, agents, contractors, licensors, and service providers (collectively, "Released Parties") from any and all liability, claims, demands, actions, causes of action, damages, losses, costs, or expenses (including attorneys' fees) of any kind arising from or related to: (i) your use of or inability to use the Services; (ii) any inaccuracies, errors, or omissions in our reports or data; (iii) any reliance on information provided through the Services; (iv) any vehicle purchase, sale, or other transaction influenced by our reports; (v) any economic loss or property damage resulting from your use of the Services; (vi) any personal injury or death resulting from vehicle defects or issues not disclosed in our reports; (vii) unauthorized access to or use of your account; and (viii) any other matter relating to the Services. This release applies regardless of whether such liability arises from the negligence, gross negligence, intentional conduct, or any other theory of liability of the Released Parties. You further agree to indemnify, defend, and hold harmless the Released Parties from any third-party claims arising from your use of the Services or violation of these Terms.

You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, and any other security information. You agree to: (a) choose a strong, unique password and keep it confidential; (b) not share your account credentials with any third party; (c) immediately notify us of any unauthorized access to or use of your account; (d) be responsible for all activities that occur under your account, whether authorized by you or not; (e) provide accurate, current, and complete information when creating your account and update it promptly when it changes; and (f) not use another user's account or impersonate any person or entity. You acknowledge that you are fully responsible for all charges, damages, and losses incurred through your account, including those resulting from unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend or terminate your account if we suspect any unauthorized access or security breach. You agree to cooperate with any investigation we conduct regarding suspected unauthorized access or violations of these Terms. If you believe your account has been compromised, you must immediately change your password and contact us at the provided support channels.

By using our Services and providing your email address and phone number, you expressly consent to receive electronic communications from VinDetailsNow. These communications may include but are not limited to: (a) transactional emails regarding your purchases, subscriptions, and account activity; (b) service-related announcements, updates, and security alerts; (c) promotional and marketing messages about our Services, features, and offers; (d) surveys and feedback requests; (e) administrative notices and policy updates; and (f) customer support responses. You agree that all electronic communications, including agreements, notices, disclosures, and other communications that we provide to you electronically, satisfy any legal requirement that such communications be in writing. Electronic communications will be deemed received by you within 24 hours of the time we transmit them. You are responsible for ensuring that your contact information is current and that you have a functioning email account capable of receiving our messages. To receive electronic communications, you must have: (i) a valid email address; (ii) internet access; (iii) a device capable of receiving and displaying emails; and (iv) software capable of reading standard file formats. You may opt out of promotional communications by following the unsubscribe instructions in those messages, but you cannot opt out of transactional or service-related communications while you maintain an active account.

You agree not to use the Services for any unlawful, harmful, or prohibited purposes. Specifically, you agree NOT to: (a) violate any applicable federal, state, local, or international law or regulation; (b) engage in any fraudulent, deceptive, or misleading activities; (c) infringe on the intellectual property rights or other proprietary rights of VinDetailsNow or any third party; (d) transmit any viruses, malware, or other harmful code; (e) attempt to gain unauthorized access to our systems, servers, or networks; (f) interfere with or disrupt the integrity or performance of the Services; (g) collect or harvest personal information of other users without their consent; (h) use automated systems (bots, scrapers, crawlers) to access the Services; (i) create multiple accounts or use false identities; (j) resell, redistribute, or commercially exploit our reports or Services; (k) use the Services to stalk, harass, threaten, or harm others; (l) post or transmit any obscene, defamatory, or offensive content; (m) engage in any activity that could damage our reputation or business; (n) circumvent any security features or access controls; (o) reverse engineer or attempt to derive the source code of our Services; (p) use the Services in any way that could overburden our infrastructure; (q) impersonate VinDetailsNow or any of its employees, representatives, or affiliates; or (r) encourage or facilitate any violations of these Terms. Violation of any prohibited use may result in immediate termination of your account, legal action, and reporting to law enforcement authorities. We reserve the right to investigate and prosecute violations to the fullest extent of the law.

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, videos, software, code, designs, interfaces, data compilations, trademarks, service marks, and trade names (collectively, "Content") are the exclusive property of VinDetailsNow or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. The VinDetailsNow name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of VinDetailsNow or its affiliates or licensors. You agree NOT to: (a) copy, reproduce, distribute, republish, download, display, post, or transmit any Content without our prior written permission; (b) use any Content for commercial purposes without a license from us; (c) modify, adapt, or create derivative works based on our Content; (d) remove, alter, or obscure any copyright, trademark, or other proprietary notices from our Content; (e) use our trademarks or logos without our express written consent; (f) register domain names, social media accounts, or business names that are confusingly similar to our trademarks; or (g) use our intellectual property in any way that suggests an affiliation, endorsement, or relationship with us without authorization. Any unauthorized use of our intellectual property is strictly prohibited and may result in civil and criminal penalties. We actively monitor for infringement and will pursue all available legal remedies, including injunctive relief and monetary damages. If you believe any Content on our Services infringes your intellectual property rights, please contact us with detailed information about the alleged infringement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. (B) VINDETAILSNOW EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING THE SERVICES, INCLUDING ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. (C) WE DO NOT WARRANT THAT THE INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. (D) YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM YOUR USE. IN NO EVENT SHALL VINDETAILSNOW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (i) your use of or inability to use the Services; (ii) any vehicle purchase or transaction influenced by our reports; (iii) unauthorized access to your account; (iv) errors or inaccuracies in our data; (v) any third-party conduct or content; or (vi) any other matter relating to the Services, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above exclusions and limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the federal laws of the United States, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the federal and state courts located within the United States for the purpose of litigating all such claims or disputes. You waive any objection to venue in such courts and any claim that such courts are an inconvenient forum. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms. Any claim or cause of action arising out of or related to your use of the Services must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred. You agree that regardless of any statute or law to the contrary, any claim or cause of action must be filed within one year after the claim arose or be forever barred. BY USING OUR SERVICES, YOU AGREE TO RESOLVE ANY DISPUTES WITH US THROUGH BINDING ARBITRATION (WHERE PERMITTED BY LAW) OR IN THE COURTS AS SPECIFIED HEREIN, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

We reserve the right, in our sole discretion, to terminate, suspend, or restrict your access to all or any part of the Services at any time, for any reason or no reason, with or without prior notice, and without liability to you or any third party. Reasons for termination may include but are not limited to: (a) violation of these Terms or any applicable laws; (b) fraudulent, abusive, or illegal activity; (c) requests by law enforcement or government agencies; (d) discontinuance or material modification of the Services; (e) unexpected technical or security issues; (f) extended periods of inactivity; (g) nonpayment of fees owed; (h) breach of payment obligations; or (i) our determination that your continued use poses a risk to us or other users. Upon termination: (i) your right to use the Services will immediately cease; (ii) we may delete your account and all associated data; (iii) you will remain liable for all charges incurred prior to termination; (iv) all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability. You may terminate your account at any time by contacting our customer support, but you will not be entitled to any refunds for prepaid fees unless otherwise specified in our Refund Policy. Termination of your account does not relieve you of any obligations incurred prior to termination. We reserve the right to pursue any legal remedies available to us for violations of these Terms.

All notices, demands, or other communications required or permitted under these Terms shall be in writing and shall be deemed given: (a) when delivered personally; (b) when sent by confirmed email to the email address you provided; or (c) when sent by certified or registered mail, return receipt requested, postage prepaid to the address you provided. Notices to you will be sent to the email address associated with your account. Notices to us must be sent via email to: [email protected]. It is your sole responsibility to ensure that your contact information is current, accurate, and deliverable. We are not responsible for any failure to receive notices due to outdated, incorrect, or invalid contact information provided by you. Email notices shall be deemed received within 24 hours of transmission, unless the sender receives notification that the email address is invalid or the email was undeliverable. You consent to receive electronic notices in lieu of paper notices and agree that such electronic notices shall satisfy any legal requirement that communications be in writing. If you wish to withdraw your consent to receive electronic notices, you must notify us in writing at [email protected], but doing so may limit your access to certain features of the Services. We may update our contact information from time to time, and the most current contact information will be posted on our website.

By providing your mobile phone number to VinDetailsNow, you expressly consent to receive transactional and promotional SMS/text messages from us or our authorized service providers. These messages may include but are not limited to: (a) order confirmations and transaction receipts; (b) account alerts and security notifications; (c) service updates and important announcements; (d) promotional offers, discounts, and marketing messages; (e) subscription renewal reminders; and (f) customer support communications. You understand and agree that: (i) message and data rates may apply as determined by your mobile carrier; (ii) you are solely responsible for any charges incurred from your carrier; (iii) message frequency may vary depending on your activity and the nature of communications; (iv) we are not responsible for any delays, non-delivery, or errors in SMS messages; (v) SMS messages are sent via automated technology; and (vi) carriers are not liable for delayed or undelivered messages. You may opt out of receiving promotional SMS messages at any time by replying "STOP" to any message, texting "STOP" to our SMS number, or contacting customer support. However, you may not opt out of transactional or security-related messages while you maintain an active account. After opting out, you may receive one final confirmation message. If you change your mobile phone number or terminate your service, you must update your account information to prevent messages from being sent to the person who acquires your old number. By consenting to SMS communications, you certify that you are the mobile phone account holder or have authorization from the account holder to receive messages at the provided number.

Our Refund Policy is incorporated into these Terms by reference and governs all refund requests. Please review our complete Refund Policy for detailed terms and conditions. In general: (a) All sales are final unless otherwise specified in our Refund Policy; (b) Refund requests must be submitted within the timeframe specified in our Refund Policy; (c) Refunds are processed at our sole discretion and may be denied if we determine abuse, fraud, or violation of these Terms; (d) If a refund is approved, it will be processed using the original payment method within a reasonable timeframe; (e) Subscription fees may be prorated based on usage, or may be non-refundable, as specified in our Refund Policy; (f) Processing fees, administrative charges, or third-party costs may be non-refundable; (g) Reports that have been accessed, downloaded, or viewed may not be eligible for refunds; (h) We reserve the right to limit or deny refunds to accounts suspected of abuse or fraudulent activity; (i) Chargebacks or payment disputes filed without first attempting to resolve the issue with us may result in immediate account termination and forfeiture of all services; and (j) Multiple refund requests or excessive chargebacks may result in permanent account suspension and prohibition from future use of our Services. Nothing in this section limits any statutory rights you may have under applicable consumer protection laws.

These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and VinDetailsNow regarding your use of the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us. SEVERABILITY: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect. WAIVER: No waiver by VinDetailsNow of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. ASSIGNMENT: You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder, in whole or in part, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may assign these Terms, in whole or in part, to any party at any time without notice or your consent. HEADINGS: The section headings in these Terms are for convenience only and have no legal or contractual effect. FORCE MAJEURE: We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. RELATIONSHIP: Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and VinDetailsNow. You have no authority to bind us or make commitments on our behalf.
